Judge approves deal in Alabama prison case over HIV | The Montgomery Advertiser | montgomeryadvertiser.com

U.S. District Judge Myron Thompson issued an opinion Monday saying the agreement isn't perfect but can take effect.

Female inmates already are living with other prisoners at the state's lone women's prison, and male inmates will be integrated into the general prison population next year.
Thompson sided with prisoners in December and ordered the Department of Corrections to quit making HIV-positive inmates live in housing areas away from other prisoners.

Thompson held two hearings last week on the resulting settlement.

The American Civil Liberties Union represents inmates who sued to end the practice.

Lerner's Pension Could Be as Much as $102,600/Year, $3.96 Million Lifetime | CNS News#sthash.MhII6Rmf.dpuf

So it was no surprise when speculation arose over how much Lerner could collect in federal pension benefits.
Unfortunately, that speculation, which initially projected a benefit of over $50,000, might be off by about half ... and in the wrong direction.

National Taxpayers Union calculations show that Lerner could qualify for a starting pension at the annual equivalent of as much as $102,600, and up to $3.96 million over her lifetime.

Marcella Hazan dies at 89; Italian cookbook author, teacher - latimes.com

Marcella would cook and recook her recipes, carefully gauging her husband's reaction. Victor, an authority on Italian wine who wrote well-regarded books of his own, would translate her recipes from Italian and write for the cookbook. No one who knew the Hazans thought of one without thinking of the other.

"In a way, all the cookbooks have been outgrowths of the eager, affectionate conversations about the day's meals that the two of them had in their first New York apartment," food writer Anne Mendelson wrote in reviewing "Marcella Cucina" for the L.A. Times.

Justice Department to sue North Carolina over voter law | Fox News

The Justice Department will announce Monday that it is suing the state of North Carolina for alleged racial discrimination over tough new voting rules.

A person briefed on the department's plans told Fox News that the suit would claim that the North Carolina statute violated Section 2 of the Voting Rights Act and would seek to have the state subject to federal pre-clearance before making "future voting-related changes." The person also said the suit would be filed Monday in U.S. District Court in Nashville, Tenn.

A War on Coal | The Weekly Standard

Since coal power plants generate over 40 percent of the nation’s electricity, these closures are bound to result in significantly higher electricity bills. They also raise troubling questions about our ability to reliably supply power in much of the country.

So how can the EPA justify regulations that amount to a regressive tax on poor people and reduce desperately needed energy production? McCarthy told the Times she wouldn’t have accepted the job at the helm of the EPA if she hadn’t been confident the president was serious about addressing climate change: “It’s an issue I’ve worked on for so many years, and it just can’t wait

Often, the prevailing prejudices of the press corps are described as “liberal bias”; explaining this as a matter of ideology or philosophy, however, is unnecessary to describing the basic political allegiance of news industry personnel to the Democrat Party. Every study of the voting habits of American journalists shows an overwhelming preference for Democrats. The Media Research Center has compiled an exhaustive collection of such studies, some showing that reporters are eight times more likely to vote for Democrats than for Republicans.

As a direct result of Reid’s irresponsible policy, Americans are now faced with what is being described by many in the media as a “budget” battle, but is in fact about the short-term alternative to an actual budget, a continuing resolution which would authorize the government to keep spending more money than it has, by borrowing billions of dollars it has no feasible plan to repay.

Thus, the architects of the "New Deal," including FDR himself, consciously intended it as the beginning of socialism in America. That, according to their designs, would open a way to a gradual convergence with Stalinist Soviet Union under a future socialist world government. In a way, that convergence had already begun, as the Roosevelt Administration was full of Soviet agents of influence, including Alger Hiss, Harry Dexter White, and crucially, Harry Hopkins--FDR’s alter ego, his "personal foreign secretary," and the most powerful man in the White House.

Consumers can express their opinions with their shopping dollars and forgo products from Barilla, one of the world's best-known makers of pasta and ready-made sauce, the group urged.

Nobel laureate Fo urged Barilla to make up for the remarks by creating an advertisement that featured a same-sex couple or parents.

The Washington, D.C.-based Human Rights Campaign, a gay, lesbian, bisexual and transgender equal rights group, posted a list on its website of five Barilla competitors that are gay and lesbian-friendly. (Barilla alternatives: http://r.reuters.com/saz43v)

"Now, more than ever, consumers are sending a message that they are watching to see if the business they patronize understand and honor issues important to them," it said.

Planned Parenthood takes Texas abortion laws to court — MSNBC

But the political odds were stacked against them, and the law ultimately cleared the Texas Legislature and was signed into law by Gov. Rick Perry. “Women shouldn’t have to go to court after every legislative session,” said Nancy Northup, president and CEO of the Center for Reproductive Rights. She added, “Women’s rights now depend on where they live.”

The clinic restrictions require abortion providers to have admitting privileges at a hospital less than 30 miles away. The women’s groups argue that “rather than protecting women’s health, the Act will harm Texas women. It will also violate Plaintiffs’ and their patients’ rights guaranteed by the Fourteenth Amendment to the United States Constitution.” The law goes into effect Oct. 29–unless is is blocked in court.

Can We Finally Start Talking About The Global Persecution Of Christians? | The Federalist

As Paul Marshall, Lela Gilbert and Nina Shea write in Persecuted: The Global Assault on Christians, “Christians are the single most widely persecuted religious group in the world today. This is confirmed in studies by sources as diverse as the Vatican, Open Doors, the Pew Research Center, Commentary, Newsweek and the Economist. According to one estimate, by the Catholic Bishops’ Conferences of the European Community, 75 percent of acts of religious intolerance are directed against Christians.”

How well does the media tell that story? And how did they cover this weekend’s events? As Anglicans and other Christians worldwide grieved the brutal attack in Pakistan, the media… did not. The worst attack on Pakistani Christians in history didn’t make the front page of the New York Times. The Washington Post buried the story on page A7 of Monday’s paper. On the front page of the BBC web site, a small headline “Pakistan church blast kills dozens” was below stories on Angela Merkel and the Emmys. By the next day, the story was nowhere to be found.

Terror Group That Claimed Kenya Attack Has Recruited Americans Before - ABC News

During Congressional testimony in January 2012, Director of National Intelligence James Clapper listed al-Shabaab as one of the most significant terror threats to the homeland, in part due to a "foreign fighter cadre that includes U.S. passport holders... [who] may have aspirations to attack inside the United States."

However, a senior law enforcement official said the latest U.S. government analysis shows no heightened threat to the U.S. as a result of the Kenya attack. While al-Shabaab does have a desire to strike at Western targets in Africa, hitting the U.S. homeland is "not a priority" for them, the official said.

Al-Shabaab claimed the attack on the Westgate Mall in Kenya was retaliation for the 2011 invovlement of Kenyan forces in anti-terror operations in Somalia.

Best of the Web Today: Rich Man, Poor Woman? - WSJ.com

New Census numbers show that U.S. women were more likely to live in poverty than men in 2012, particularly if they're raising families alone. Over 30 percent of families led by single moms are living in poverty, compared to 16.4 percent of families led by single dads. Families run by women bring in a median annual income of $34,002; those led by men bring in $48,634 a year. There are also a lot more families living in the former category than the latter.
In total, 14.5 percent of American women lived in poverty in 2012, compared to 11 percent of men. According to the National Women's Law Center, poverty rates are even higher for black women (25.1 percent are living in poverty) and Hispanic women (24.8 percent). Women are more likely to be poor than men at every age: Among people between the ages of 18 to 64, 15.4 percent of women are in poverty, compared to 11.9 percent of men. Above age 65, 11 percent of women are in poverty, compared to 6.6 percent of men. Even girls under age 18 are slightly more likely to live in poverty than boys are.

House CR Forks Over $174,000 for Late Senator's Wife | 218

The death gratuity — a long-practiced, little-known, unofficial perk of office — has been a staple of congressional deaths. A Congressional Research Service report on members who die in office says:

“…it has been the typical practice of the House to provide a death gratuity equal to the member’s annual salary, payable to the deceased member’s widow or widower, or children either in the annual legislative branch appropriations act or a measure providing supplemental funds for the legislative branch. By statute, a death gratuity is considered a gift.”

Before Lautenberg’s death, he was No. 8 on Roll Call’s 50 Richest Members of Congress with a net worth of at least $56.8 million.

That raises a question for the government watchdogs at Citizens for Responsibility and Ethics in Washington: ”Why is the government throwing money at a multimillionaire?”

In a post on CREW’s website, Daniel Schuman says the situation is “even more galling” when you think about the choice it represents.

Although the media seem to have forgotten, in 2010 Omar Thornton murdered eight of his coworkers at Hartford Distribution after being caught on video stealing inventory. 'I killed the five racists that was there bothering me," he said in the way of explanation.

DeLay’s Vindication, Texas’s Shame | National Review Online

As Justice Goodwin notes in her opinion, Mr. DeLay’s political-action committee followed standard practices, segregating soft money and hard money in separate accounts. Democratic PACs operating at the same time had followed exactly the same procedures in the handling of comparable sums of money, here $190,000. As the justice writes, Mr. DeLay’s organization “did not transfer funds between these two accounts. . . . There was no evidence that [DeLay’s PACs] treated the corporate funds as anything but what they were, corporate funds with limited uses under campaign finance law.” In the court’s most damning finding, the justice writes that DeLay was prosecuted not for attempting to circumvent the law but for trying to satisfy it: “The evidence shows that the defendants were attempting to comply with the Election Code limitations on corporate contributions.”

Women Waiting Tables Provide Most of Female Gains in U.S. - Bloomberg

It’s almost 6 p.m. on a Friday and the tables near the bar at The Hamilton in downtown Washington are getting crowded. That means waitress Victoria Honard is busy.

Honard, 22, who graduated from Syracuse University in May, works about 25 hours a week at the restaurant while looking for a job related to public policy. She moved to Washington four days after graduation with the hope of finding a position at a think tank or policy-related organization, she said, and has applied to about 20 prospective employers.

Syria’s 2 million Christians face an intolerable dilemma. The bad option is for Bashar al-Assad to retain his brutal grip on power. The worse option — for Chistians, at least — is for Assad’s dictatorship to fall.

As some have predicted, persecution of the country’s Christian minority is escalating as the civil war spreads. Islamists, who now dominate the opposition, have embarked on a bloody campaign of genocide against Christians, who constitute about 10 percent of the population.

Anyone who doubts it need simply observe market behavior after Fed Chairman Ben S. Bernanke announced Wednesday that the central bank will continue buying securities at the rate of $85 billion per month — contrary to expectations that it would begin to “taper” those purchases, which have already swollen the Fed’s balance sheet to roughly four times its pre-crisis size. Bulls went wild, believing that the Fed’s easy-money policies, which help prop up the price of stocks and other assets, may continue at least through the end of Mr. Bernanke’s term early next year.

Ayvani's mother, Maria Corral, and Juan Alberto Contreras-Rodriguez were among five people arrested during a drug raid in 2012 in Henry County, south of Atlanta, Immigration and Customs Enforcement agents told CNN affiliate WSB-TV.

Drug agents found 500 pounds of marijuana in the home where the bust took place, WSB said. All were charged with trafficking marijuana.

Property is surely a right of mankind as really as liberty. ... but the time would not be long before courage and enterprise would come, and pretexts be invented by degrees, ... in sharing it equally with its present possessors. Debts would be abolished first; taxes laid heavy on the rich, and not at all on the others; and at last a downright equal division of every thing be demanded, and voted. What would be the consequence of this? The idle, the vicious, the intemperate, would ... sell and spend all their share, and then demand a new division of those who purchased from them. ... anarchy and tyranny commence.

The Majority of SNAP Recipients Live in the Suburbs

But increasingly, the ’burbs are becoming the defining image of food stamps. The number of Americans living in suburbs who receive SNAP doubled between 2007 and 2011, and the majority recipients nationwide—55 percent—now live there, according to an analysis of American Community Survey data by the Brookings Institution.

“Many of the regions that saw the steepest increases in food stamp receipt were Sun Belt metro areas hit hardest by the collapse of the housing market and recession that followed,” writes Elizabeth Kneebone, a fellow at Brookings’ Metropolitan Policy Program and co-author of Confronting Suburban Poverty in America. This includes cities like Modesto, CA, Tampa, FL, and Riverside, CA, “where the number of suburban households receiving SNAP benefits more than tripled, as well as regions like Cape Coral, Las Vegas, and Atlanta, where suburban SNAP receipt more than doubled.”

Articles: The Myth of Red State Welfare

Furthermore, it's equally nonsensical to just consider how a state votes for the president. We also need to look at how each state votes for its senators, representatives, and even governors. Given how Congress has the "power of the purse," this is core to assessing how a state's welfare status relates to its Democrat versus Republican voting record. And this is where the "red state welfare" hypothesis disintegrates.

But the new report says the true figure since 1951 has been only 0.12C per decade – a rate far below even the lowest computer prediction

It is true that 164,000 seasonally adjusted payroll jobs were added during the month, per the Establishment Survey of employers, but June and July were revised down by a combined 75,000. The Household Survey used to determine the unemployment rate had even grimmer news, as it showed that 115,000 fewer Americans were working in August than in July. The only reason that the official (“U-3″) unemployment rate fell to 7.3 percent is because the civilian workforce shrunk by over 300,000, taking the labor force participation down to 63.2 percent, that figure’s lowest level in since 1978.

Looking back further, since President Obama was first inaugurated in January 2009, seasonally adjusted employment per the Household Survey has increased by just over 2 million, while the number of adults not in the labor force has skyrocketed by almost 10 million.

That's my judgment as commander-in-chief. But I’m also the president of the world’s oldest constitutional democracy. So even though I possess the authority to order military strikes, I believed it was right, in the absence of a direct or imminent threat to our security, to take this debate to Congress. I believe our democracy is stronger when the president acts with the support of Congress. And I believe that America acts more effectively abroad when we stand together. This is especially true after a decade that put more and more war-making power in the hands of the president, and more and more burdens on the shoulders of our troops, while sidelining the people’s representatives from the critical decisions about when we use force.

He had said he was heading to a nearby park to burn 2,998 Qurans — one for every victim of the Sept. 11, 2001, terrorist attacks. Sheriff’s officials said they would hold a news conference later Wednesday to discuss specific charges.

Guest Post: Our Huge, Stinking Mountain of Debt: Student Loans | Zero Hedge

Sometimes I picture in my mind a huge, stinking mountain of debt, which represents all of the debt in the world. The debt mountain is usually growing, but because of defaults, fissures and sinkholes often appear; so even as it is expanding, parts of it are collapsing. Insiders know which parts of the mountain are safe and solid, but small investors are often plunged into one of the many bottomless pits that pockmark the surface of the rotten debt mountain.

The Muslim Brotherhood and its supporters have began forcing the roughly 15,000 Christian Copts of Dalga village in Egypt to pay a jizya tax as indicated in Koran 9:29, author and translator Raymond Ibrahim reported on Sunday.

Jizya is the money, or tribute, “that conquered non-Muslims historically had to pay to their Islamic overlords ‘with willing submission and while feeling themselves subdued’ to safeguard their existence,” Mr. Ibrahim explained.

Treasury: Debt Up $0 in August; CBO: But Deficit Was $146B | CNS News

(CNSNews.com) - The federal deficit increased by $146 billion in August, according to a report released today by the Congressional Budget Office. But, at the same time, according to the U.S. Treasury, the federal debt did not increase at all during the month.

Total federal receipts were $185 billion during August, according to the CBO, while total federal outlays were $331 billion. Thus, the Treasury was forced to engage in $146 billion in deficit spending.

Despite this deficit spending, the Treasury reported that at the close of every single business day in August, the federal debt subject to a legal limit by Congress remained exactly $16,699,396,000,000.

According to researchers from the George Washington University (GWU) School of Public Health, in 2010, almost half of all births in the United States were paid for by Medicaid, and that rate is only going to go up. Medicaid was responsible for 48% of the 3.8 million births in 2010, an increase of 90,000 births from 2008, which was an 8% increase during that period.

Let’s face it: The US job market is dead in the water and not getting better | AEIdeas

Sure, the unemployment rate fell to 7.3%. But that’s only because the labor force participation rate fell to a 35-year low. If it were still at January 2009 levels, the unemployment rate would be 10.8%. As RDQ Economics cautions, “This continued fall in participation should give pause to those who argue that the decline is cyclical and will be reversed.” In other words, the US faces a permanently larger pool of jobless Americans.

Feds Spending $2.2 Million to Study Lesbian Obesity

The federal government has spent $2.2 million studying why three quarters of lesbians are obese despite sequestration-mandated budget cuts that critics warned could “delay progress in medical breakthroughs.”
The National Institutes of Health awarded an additional $682,873 to Brigham and Women’s Hospital for the study on July 17. The project had received previous grants of $778,622 in 2011, and $741,378 in 2012. Total funding has reached $2,202,873.

Yes, Congress Can Authorize War Without Formally 'Declaring' It

There are already two general positions about such an authorizing resolution. One view regards it as lawless, on the grounds that any use of force is illegal unless Congress has passed a bill "declaring war." John Nichols of The Nation, for example, sees every military conflict since World War II as illegal, because presidents since Franklin Roosevelt "have not obtained the formal declarations of war required by the Constitution."

Cornelia Pillard, Obama’s radical feminist judicial nominee

Pillard is also a pro-abortion extremist. The right to an abortion, she argues, is necessary to help to “free[] women from historically routine conscription into maternity.” She also contends that men and women who oppose government mandates on employers to provide insurance coverage for contraception “reinforce[] broader patterns of discrimination against women as a class of presumptive breeders.”
Pillard isn’t a fan of ultrasound. She complains that it produces “deceptive images of fetus-as-autonomous-being that the anti-choice movement has popularized since the advent of amniocentesis.” The notion that ultrasound produces images of autonomous beings is absurd. No one claims that the images are of something that is autonomous. Pillard’s concern is that the images look too much like something people want to protect.

In Saudi Arabia last year, 5-year-old Lama al-Ghamdil was killed by her father -- Islamic religious leader and popular TV personality Imam Fayhan al-Ghamdi -- after he became incensed she had lost her virginity. Even more shocking, however, is the person to whom her virginity was lost and the initial punishment he was given.
